Attributions

In addition to the general powers and functions conferred upon the Presidency—empowering the President to exercise full authority over the management of the Authority’s affairs, to ensure its effective operation, to act as its legal representative and official spokesperson, and to preside over its Council and standing committees—the President is further vested with the following exclusive prerogatives:

 

  • To receive reports and complaints submitted to the Authority.

 

  • To inform whistleblowers and complainants of the disposition and outcome of their reports and complaints.

 

  • To refer whistleblowers and complainants to the competent authorities in cases where the Authority lacks jurisdiction.

 

  • To order immediate interventions and to transmit the corresponding reports to the competent Public Prosecutor.

 

  • To designate one or more officers of the Authority and to direct them to conduct inquiries and investigations.

 

  • Where appropriate, to formally petition the competent Public Prosecutor to authorize the participation of judicial police officers in investigations conducted by the Authority’s officers.

 

  • To request, in the name of the Authority, the assistance of public law enforcement authorities, through the competent Public Prosecutor, in support of the Authority’s officers in the performance of their official duties.

 

  • To formally request from relevant authorities the information and documentation required by the Authority for the discharge of its functions.

 

  • To replace an officer of the Authority in cases of recusal.

 

  • To transmit official reports and case files to the competent authorities, in accordance with decisions adopted by the Executive Committee.

 

  • To notify, on behalf of the Authority, the Judicial Agent of the Kingdom of any cases referred by the Authority to the competent courts, in order to allow the State to join the proceedings as a civil party.

 

  • To bring matters before the competent authorities in cases where the operations or functions of the Authority are obstructed.

 

  • To oversee and coordinate the Authority’s cooperation with other law enforcement and regulatory bodies.

 

  • To report to the Council on the measures taken and outcomes achieved regarding reports and complaints submitted to the Authority.
